1. GENERAL INFORMATION

These General Terms and Conditions of Sale (hereinafter referred to as: « GTC ») constitute a contract between you (hereinafter: « the Customer ») and Taikine SA, a Swiss company with its registered office at 2, chemin du Vuasset, 1028 Préverenges, Switzerland (hereinafter: « the Company »). The GTC govern your use of the website www.activshape.com and any other related site, application, or tool (hereinafter: the « Site »), operated by the Company.

By using this Site and/or by clicking on « I certify that I have read and agree to these General Terms and Conditions of Sale », you confirm that you have read and accepted the GTC and agree to comply with the applicable laws and regulations. If you do not agree to these GTC, you must refrain from using the Site.

The Site allows you to order online the following products (hereinafter: « the Products »):

* ActivShape "Fat Burner"
* ActivShape "Appetite Suppressant"

You must be at least 18 years old and capable of entering into contracts under the applicable law of your country to order from the Site.

The steps to conclude a contract are as follows:

1. Selecting the Products and the quantity of Products,
2. Entering your personal data via the online order form,
3.Entering payment details via a secure page,
4. Verifying and confirming the order,
5. Receiving an order confirmation email.

By placing an order, you declare that you have the legal capacity to accept these GTC.

The Company may modify the GTC at any time. You will be informed of these changes. Continued use of the Site constitutes acceptance of the updated GTC. The Company reserves the right to suspend or cease operation of the Site at any time.

2. PRICES AND PRODUCTS

Prices are indicated in CHF, EUR, GBP, USD, or CAD, depending on the currency selected by the Customer. They include Swiss VAT or VAT of the destination country when applicable and according to the applicable rate. Displayed prices do not include any import taxes or customs duties, which are solely at the Customer's expense.

The Company reserves the right to modify its prices without notice. Already confirmed orders will be billed at the price in effect at the time of confirmation.

The Products remain the property of the Company until full payment of the due amount.

3. PROGRAMS AND SCHEDULED DELIVERIES

Products offered as a "Program" (Cure) involve a scheduled and recurring delivery service. By selecting a Program offer to benefit from a preferential rate or an advantage linked to the continuity of the treatment, the Client expressly accepts the setup of a subscription with automatic renewal, until cancelled by the Client.
Operation and Billing The Client acknowledges that the subscription begins as soon as the initial order is validated. Renewal: The order will be automatically renewed at the frequency defined at the time of purchase (e.g., monthly) to ensure the continuity of the Program.
Pricing: The Client will be charged at each interval using the saved payment method, at the price agreed upon during the initial subscription.
Example: A Program subscribed to at the privileged rate of €49.95 (for a product with a standard unit price of €64.95) will be automatically renewed each month at that same rate of €49.95.
Program Management and Cancellation The Client will receive an email notification confirming the terms of their subscription at the time of purchase. In accordance with current regulations, a reminder notification will be sent before renewal if the pricing conditions change or at the end of a trial period.
The Client may stop their Program and suspend scheduled deliveries at any time and free of charge by emailing help(at)activshape.com or via the online form provided for this purpose. The cancellation must be completed before the date of the next billing cycle.

4. SECURE PAYMENT

Payments are made by credit card or other secure methods offered on the Site. The Company uses a platform compliant with current security standards. The order is processed only after payment is received.

5. DELIVERY AND SHIPPING COSTS

The Company ships orders within 72 hours working days after payment validation, subject to stock availability.

In case of temporary stock shortage, an additional delay may be applied.

Any shipping costs are indicated before order validation. They may be offered under certain conditions.

It is the Customer’s responsibility to provide an accurate delivery address. In case of return due to an incorrect address or non-retrieval of the package, the Customer will bear the re-shipment costs.

6. RIGHT OF WITHDRAWAL

The Customer has a right of withdrawal of 14 days from the receipt of the Products, without justification. The request must be submitted via the online form or by email to help@activshape.com. The Customer then has 14 days to return the Products, at their expense. The refund will be made within 14 days after the receipt of the returned Products.

7. “SATISFIED OR REFUNDED” GUARANTEE

The Customer benefits from a « satisfied or refunded » guarantee of 30 days after receipt of the order. Returns must be made within the specified period, with the risks and return costs borne by the Customer.

8. RETURN OF A DEFECTIVE PRODUCT

In case of a defective Product (detected within 14 days of receipt), return costs will be covered by the Company upon customer service approval. Prior contact required: help@activshape.com.

9. CLAIM AND MEDIATION

Customer service is reachable Monday to Friday, from 9:00 am to 6:00 pm, by email: help@activshape.com.

10. LIABILITY

The Products comply with Swiss legislation. The Customer is responsible for verifying the legality of importation in their country. The Company cannot be held responsible in case of import rejection or restrictive local legislation.

11. DATA PROTECTION

The Customer consents to the use of their personal data for order processing. The Privacy Policy is available on the Site and complies with Swiss data protection legislation.

12. INTELLECTUAL PROPERTY

All contents on the Site are the exclusive property of Taikine SA. Any reproduction or use without authorisation is prohibited.

13. EXTERNAL LINKS

The Site may contain links to other sites whose content is not under the control of the Company. The Company declines all responsibility for the content of these sites.

14. SERVICE INTERRUPTION

Temporary interruptions of the Site may occur (maintenance, updates, etc.). The Company cannot be held responsible for such interruptions.

15. NETWORK SECURITY

Data transmission over the internet cannot be fully secure. The Company makes every effort to ensure confidentiality but cannot guarantee absolute security.

16. INDEMNIFICATION

The Customer agrees to indemnify the Company against claims related to the improper use of the Site or the Products.

17. ENTIRE AGREEMENT

The GTC, together with the Privacy Policy, constitute the entire agreement between the Client and the Company.

18. ASSIGNMENT RIGHTS

The Company may transfer its rights and obligations under these GTC to any other entity.

19. PARTIAL INVALIDITY

If any provision of these GTC is declared invalid, the remaining provisions shall remain in force.

20. APPLICABLE LAW AND JURISDICTION

These GTC are governed by Swiss law.
The legal venue is at the seat of Taikine SA in Lausanne, Switzerland. In case of dispute, the parties will favour an amicable resolution.
